Terms of Service

1. Acceptance of Terms

By accessing or using BantuziEvents (“the Service”), operated by Bantuzi Enterprises Limited, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use the Service. These terms apply to all users, including event organizers, team members, vendors, and guests.

2. Description of Service

BantuziEvents is a multi-tenant software-as-a-service (SaaS) platform for event management. The Service enables organizations to create and manage events, sell tickets, handle RSVPs, generate invoices, manage vendors, track budgets, and coordinate teams. Features and capabilities may vary depending on your subscription plan.

3. Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Maintain the security and confidentiality of your password.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to create an account. Each person may maintain only one account. Organizations must designate an authorized representative to manage their account.

4. Subscription & Billing

Paid subscription plans are billed on a monthly or annual basis as selected at the time of purchase. All prices are quoted in Zambian Kwacha (ZMW) unless otherwise stated. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. Refunds are provided at our sole discretion and are not guaranteed. We reserve the right to change pricing with 30 days' written notice to affected customers.

5. Acceptable Use

You agree not to use the Service to:

• Organize, promote, or facilitate illegal events or activities.
• Send unsolicited communications, spam, or bulk messages.
• Scrape, crawl, or extract data from the platform by automated means.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Upload content that infringes intellectual property rights or contains malware.
• Interfere with or disrupt the integrity or performance of the Service.

6. Intellectual Property

The BantuziEvents name, logo, brand identity, source code, design, and all associated materials are the exclusive property of Bantuzi Enterprises Limited. All rights are reserved. You may not use our trademarks without prior written consent. Your content — including events, attendee data, documents, and media — remains your property. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide and improve the Service.

7. Data & Privacy

Your data is governed by our Privacy Policy. We process personal data as described therein. By using the Service, you consent to the collection, storage, and processing of your data in accordance with our Privacy Policy.

8. Service Availability

We target 99.9% uptime for the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance that temporarily affects availability; such maintenance will be communicated in advance via email or in-app notification. We are not liable for any loss or damage resulting from service interruptions, whether planned or unplanned.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Bantuzi Enterprises Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, use, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the total fees paid by you during the twelve (12) months immediately preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms of Service or engage in conduct that we determine, in our sole discretion, is harmful to other users or the Service. You may cancel your account at any time by contacting us. Upon termination, your data will be soft-deleted and retained for 90 days, during which time you may request a data export. After 90 days, data is permanently removed.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will notify you via email or a prominent notice within the Service. Your continued use of the Service after such changes constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the Service.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Lusaka, Zambia.
